The executive order banning birthright citizenship, signed by U.S. President Donald Trump, has taken effect in some states. On June 27 (local time), the U.S. Supreme Court ruled that it is excessive for a single lower court to suspend the entire federal government policy nationwide.

As a result, the executive order banning birthright citizenship, signed by President Trump, will take effect in 28 states, excluding 22 states and Washington, D.C., where lawsuits were filed and injunctions were granted, starting 30 days from now. The Supreme Court's decision was made with six conservative justices in favor and three liberal justices opposed.


President Trump signed the executive order in January of this year, immediately after taking office, to prevent granting citizenship to children born to undocumented immigrants or non-permanent resident parents. In particular, the order specifies that if the mother is an undocumented or temporary resident and the father is neither a citizen nor a permanent resident, the child will not be granted citizenship.


Immediately after the executive order was issued, 22 states with Democratic governors and Washington, D.C., filed lawsuits claiming it was unconstitutional, and some lower courts temporarily suspended the policy's effect. However, the Supreme Court's latest ruling limits the nationwide application of such lower court decisions, clarifying that the injunctions are valid only for the parties involved in the lawsuits.

In its written decision, the Supreme Court stated, "Nationwide injunctions may exceed the authority delegated to federal courts by Congress." In response, liberal Justice Ketanji Jackson expressed a dissenting opinion, stating that "this decision allows for the violation of constitutional rights of those who did not file lawsuits."


Immediately after the ruling, President Trump declared a "Big Win" on his social media account.


Meanwhile, the regions where the ban on birthright citizenship remains suspended include Washington, Arizona, California, New York, Oregon, New Jersey, and 16 other states, totaling 22 states. In the remaining 28 states, the policy is scheduled to take effect in 30 days. The controversy over birthright citizenship in American society is expected to intensify further.
