Gwangju District Court: "Loss of Public Trust, Suspension Justified"
Lawsuit Dismissed After Reduction from Dismissal to Suspension
Disgrace Amid Emphasis on Public Service Discipline... Court Upholds Decision
At a time when the establishment of discipline among public officials is being emphasized, a former police officer who caused controversy over a sexual harassment incident involving a woman filed a lawsuit challenging his disciplinary action, but the court did not accept his claim.
On April 28, the Gwangju District Court Administrative Division 1 (Presiding Judge Kim Jeongjung) announced that it had ruled against the plaintiff in a lawsuit filed by former police officer A against the Jeonnam Provincial Police Agency Chief, seeking to overturn his disciplinary action.
In November of last year, A was booked on charges of molesting a woman he met at a nightclub in Seo-gu, Gwangju, and was referred to a disciplinary committee. At the time, A was a probationary police officer and was dismissed from his position, but after a review by the Ministry of Personnel Management’s Appeals Commission, the disciplinary action was reduced to a three-month suspension.
The court stated, "By failing to uphold the high standards of legality and morality required of police officers, the plaintiff undermined public trust," and ruled that the disciplinary action was justified.
