Kang Moonseong, Jeonnam Provincial Assembly Member: "The Illegal Martial Law of December 3 Must Be Punished"

Representative Proposal for the "Special Act on the Punishment of Constitutional Disruption"

Kang Moonseong, a member of the South Jeolla Provincial Council (Democratic Party of Korea, Yeosu 3), on the 15th, proposed a resolution urging the enactment of the "Special Act on the Punishment of the 12.3 Martial Law Constitutional Disruption Incident" at the 1st plenary session of the 389th extraordinary session of the South Jeolla Provincial Council.


This resolution calls for a thorough investigation into the martial law declared on December 3 of last year and demands strict punishment for those involved. The resolution specifies effective legislative measures, including ▲ the establishment of a special investigation committee to uncover the truth ▲ punishment and disqualification from candidacy for those involved in constitutional disruption ▲ initiation of procedures to dissolve supporting political parties.

Kang stated, "The 12.3 martial law incident is a grave act of constitutional disruption that directly denies the sovereignty of the people and the constitutional order," and insisted, "A thorough investigation and strict punishment must be carried out for all those involved, including not only the leading forces but also participants, instigators, propagandists, and those who spread false information."


He emphasized, "Martial law is an act of constitutional destruction that should never occur in a country governed by the rule of law," and added, "Treason against the Constitution can never be justified under any pretext, and if we fail to hold those responsible accountable, the very foundation of the democratic republic will be shaken." Kang argued, "There are limitations to revealing the full truth of this incident and punishing those involved solely under the crime of insurrection in the Criminal Act," and insisted, "A special law with a structure similar to the Anti-National Activities Punishment Act enacted in 1948 is necessary."


He continued, "If we do not correct the attempt to undermine the constitutional order, similar incidents may recur," and urged, "The National Assembly must take responsible action and enact the special law before it is too late."
