LS-Daehan Jeonseon Ends 5 Years 8 Months Patent Lawsuit Without Appeal

The patent infringement lawsuit between LS Cable & System and DaeHan Cable has been concluded with both parties withdrawing their appeals. As a result, LS Cable & System's final victory has been confirmed, bringing an end to the legal dispute that lasted for 5 years and 8 months.

According to the industrial and legal sectors on the 8th, the 24th Division of the Patent Court finalized the second-instance ruling in the 'Patent Infringement Damage Compensation Lawsuit for Busduct Joint Kit Products' filed by LS Cable & System against DaeHan Cable.

Earlier, on the 13th of last month, the court ruled that DaeHan Cable infringed LS Cable & System's patent rights and increased the compensation amount recognized in the first trial from 490 million KRW to 1,516,281,290 KRW.

Civil lawsuits become final if no appeal is filed within two weeks after the delivery of the judgment. Both LS Cable & System and DaeHan Cable did not submit appeals within this period, so the ruling was confirmed as is.

A representative from DaeHan Cable stated, "Although there were grounds for dispute regarding technical interpretation and the method of calculating damages, we decided not to appeal in respect of the court's decision." They added, "We will end unnecessary conflicts and focus on practical business activities."

A representative from LS Cable & System said, "We will continue to respond firmly to any technological infringements to protect the core technologies developed by our employees."

This lawsuit began in August 2019 when LS Cable & System filed a suit against DaeHan Cable, claiming that the busduct joint kit products infringed on their patents. A busduct is a power distribution method supplying electricity within buildings, and a joint kit is a component that connects it.

In the first trial in September 2022, the court recognized partial victory for LS Cable & System, but both parties appealed regarding the appropriateness of the compensation amount and the issue of patent infringement.

Meanwhile, although this patent lawsuit has been concluded, police investigations into allegations of leakage of design know-how for the submarine cable factory are ongoing, so the conflict between the two companies is expected to continue for the time being.
