"Indictment Procedure Violates Legal Regulations"
Daegu Mayor Hong Jun-pyo stated on the 23rd regarding the charge of leading a rebellion applied to President Yoon Seok-yeol, "If a proper judge makes the ruling, the indictment will be dismissed."
In a post on his Facebook that day, Mayor Hong added, "Because the prosecution was based on investigation materials from the Corruption Investigation Office for High-ranking Officials (CIO) and the prosecution, which do not have the authority to investigate rebellion charges due to the investigation authority adjustment made by former President Moon Jae-in, it falls under the case where the indictment procedure stipulated in Article 327, Paragraph 2 of the Criminal Procedure Act violates legal regulations and is therefore invalid."
He further emphasized, "Just as the previous ruling to cancel the detention was made due to errors in calculating the detention period and issues regarding the existence of investigation authority, the main trial will inevitably have to result in a dismissal of the indictment."
