The U.S. International Trade Commission (ITC) has ruled in favor of Samsung Display in the 'OLED patent infringement' lawsuit against Chinese display manufacturer BOE.
According to industry sources on the 20th, on the 19th (local time), the ITC announced in the patent infringement lawsuit filed by Samsung Display that "BOE and U.S. parts wholesalers Injured Gadget and Wholesale Gadget Parts infringed three and four of Samsung Display's patents, respectively."
This is the final recognition of BOE's patent infringement, two years and three months after the lawsuit was filed in December 2022.
However, the ITC decided not to impose a ban on the import and sale of BOE products within the United States, judging that there is no impact on the domestic display industry.
Samsung Display expects this recognition of patent infringement to work favorably in the remaining patent disputes.
Meanwhile, separately from this lawsuit, a preliminary decision on the trade secret infringement lawsuit filed by Samsung Display against BOE and its subsidiaries at the ITC in October 2023 is also expected by the end of this month.
BOE is accused of infringing trade secrets, including the theft of company technology, through Samsung Display’s partners and current and former executives and employees.
Additionally, Samsung Display filed a patent infringement lawsuit against BOE at the U.S. District Court for the Eastern District of Texas at the end of 2023.
Samsung Display stated, "We will continue to protect the intellectual property accumulated through massive capital and manpower investment since the early commercialization of OLED and strictly respond to patent infringement acts to maintain market competitiveness."
