Cheon Dae-yeop, Chief of the Court Administration Office (Supreme Court Justice), stated that the prosecution needs to file an immediate appeal regarding President Yoon Seok-yeol's release order cancellation. In response, the Supreme Prosecutors' Office said it is "under review."
On the afternoon of the 12th, the Supreme Prosecutors' Office announced to the press corps, "We are reviewing the situation related to today's Judiciary Committee," adding, "We cannot confirm specific details."
Chief Cheon appeared at the National Assembly's Legislation and Judiciary Committee's current issues inquiry and said, "We share the view of the trial court (Seoul Central District Court Criminal Division 25) that it is necessary to seek a higher court's judgment through an immediate appeal on this matter."
Earlier, when the Seoul Central District Court canceled President Yoon's detention, the prosecution said it was "difficult to accept," but refrained from filing an immediate appeal against the release order cancellation or similar measures such as bail and suspension of detention execution, citing that the Constitutional Court had previously ruled such immediate appeals unconstitutional. Consequently, President Yoon was released on the 8th.
The Supreme Prosecutors' Office stated that following a review by the leadership and under the final directive of Prosecutor General Shim Woo-jung, they "instructed to actively present opinions to the main trial court and respond accordingly," indicating they would challenge the court's decision's legitimacy in the main trial.
However, some in the legal community pointed out that even if the prosecution released President Yoon, they should at least seek a higher court's judgment through an appeal. With the Chief of the Court Administration Office, who oversees judicial administration nationwide, also expressing the need for a higher court's judgment, the prosecution's dilemma deepened.
