"Difficult to Understand the Prosecution's Hesitation to Release"
The People Power Party stated on the 8th regarding President Yoon Seok-yeol's release, "We feel relieved that the illegal detention has finally been lifted," and added, "Now it is the Constitutional Court's time."
Park Soo-min, the floor spokesperson for the People Power Party, held a briefing at the National Assembly on the same day and said, "With (President Yoon's) release as a turning point, the distortions and flaws in the martial law investigation process have barely begun to return to a normal track."
Regarding the court that decided to cancel President Yoon's detention, Park expressed, "We pay respect to the court that ruled according to conscience and conviction," and evaluated, "They upheld the dignity and pride of the judiciary of the Republic of Korea as the last bastion."
He expressed regret toward the prosecution for delaying the release order by more than a day. Park said, "The court considered all relevant matters and canceled the detention, so it is difficult to understand why the prosecution hesitated to release, thinking there might be room for reconsideration of the court's ruling."
He called for wise deliberation from the Constitutional Court ahead of the final ruling on President Yoon's impeachment trial. Park emphasized, "With the president's release as a turning point, the Constitution and the rule of law of the Republic of Korea must enter a path of recovery," and "The Constitutional Court must conduct balanced and wise deliberations solely within the principles of the Constitution."
He particularly pointed out that the prosecution's investigation records on the president should not be used as evidence in the constitutional trial. Park stated, "Those investigation records have been seriously discredited by the court's decision to cancel the detention," and "They must not be used as evidence in a constitutional trial that is contaminated and flawed."
He further noted, "The dictatorship and constitutional destruction acts by the National Assembly, which were the reasons for the president's martial law and the declaration of martial law, must be judged in a balanced manner," and clarified, "Martial law and rebellion are entirely different."
Park added, "The fabricated and created prejudice that 'martial law equals rebellion' must disappear," and "Only then can the Constitutional Court's guidance on the president's impeachment trial, which has caused countless controversies, be healed."
The prosecution sent the release order to Seoul Detention Center on the afternoon of the day, about 27 hours after the court made the decision to cancel President Yoon's detention around 2 p.m. the previous day. President Yoon was released after 52 days of detention.
