According to media reports, Prosecutor General Shim Woojeong and the Supreme Prosecutors’ Office leadership reportedly instructed the Special Martial Law Investigation Headquarters to direct the release of President Yoon. In response, the emergency action group condemned the decision, saying, "The decision by the prosecution leadership is an act of abetting insurrection for political gain by inciting social chaos."

They further argued, "The prosecution's refusal to search and seize the 'Bihwaphone server,' which could reveal the truth behind the insurrection, and their decision not to detain Kim Sunghoon, the deputy chief of security and a key figure in the insurrection, raise suspicions that the prosecution itself was involved in the illegal martial law."

The group also warned, "Releasing Yoon Sukyeol is a betrayal of the people's demand for his dismissal and punishment," and added, "If the prosecution pushes ahead with this, they will not be able to avoid national judgment as accomplices to the insurrection."

The emergency action group called on the Special Martial Law Investigation Headquarters to immediately appeal the decision to cancel Yoon Sukyeol's detention.
