"The Dam of False Agitation Has Collapsed"
"This Is Not for the Prosecution to Debate"
"Release the President Immediately Without Delay"
Na Kyungwon, a member of the People Power Party, described the court's decision to cancel President Yoon Sukyeol's detention as "an expected outcome."
On March 7, through her social media account, Na stated, "The prosecution should immediately release the president by dropping its appeal." She added, "This illegal detention began with false incitement of rebellion by Lee Jaemyung and the Democratic Party from the very start," and argued, "Every step of the process was unlawful, including the Corruption Investigation Office for High-ranking Officials (CIO)'s unauthorized investigation into rebellion, judge shopping, falsified documents, and the prosecution's violation of the detention period."

She went on to say, "The head of the CIO should be impeached, and the CIO must be abolished," emphasizing, "Those who participated in the president's illegal detention, undermining the rule of law and constitutional order, must be held fully accountable." She continued, "The dam of false agitation has collapsed. The cancellation of the president's detention is only the beginning," and stressed, "Now we must restore due process and the rule of law, step by step. The Constitutional Court should not take the significance of this cancellation lightly."
Additionally, in a follow-up post, Na noted, "In its 2012 decision (2011Hun-Ga36), the Constitutional Court clearly declared that 'if the effect of a court's decision regarding the necessity of a defendant's detention or its continuation is subject to challenge or limitation by the prosecution or any other body, this violates the principle of warrant requirement.'" She added, "In short, this is not a matter for the prosecution to comment on any further," and insisted, "There should be no delay; release the president immediately."
She stated, "The essence of the warrant requirement is that compulsory investigations restricting personal liberty must be determined solely by a judge," and asserted, "Neither the prosecution, the CIO, nor anyone else can influence this." She concluded, "The cancellation of the president's detention and his immediate release are the natural results of the constitutional principle of warrant requirement and due process," and added, "This is delayed justice that should never have been delayed in the first place."
Earlier that morning, the court granted the request to cancel the detention of President Yoon, who was facing charges of leading a rebellion. In response, the leadership of the ruling bloc welcomed the court's decision, while the opposition called for the prosecution and others to be held accountable and urged them to appeal in order to continue the detention.
