'Job Inspection Opposition' Constitutional Court to Deliver Ruling on Election Commission-Audit Board Jurisdiction Dispute on 27th

The National Election Commission will reach a conclusion on the jurisdictional dispute adjudication filed over the Board of Audit and Inspection's (BAI) job inspection, which it claims is problematic.

According to the legal community on the 26th, the Constitutional Court has notified both parties that the verdict date for the jurisdictional dispute adjudication case filed by the Election Commission against the BAI will be tomorrow (the 27th) at 10 a.m. The Constitutional Court held two public hearings in December last year and January this year to hear the arguments from both sides.


The key issue in this jurisdictional dispute adjudication is whether the BAI's job inspection of the Election Commission's personnel management practices from July to November 2023 infringed upon the Election Commission's authority granted by the Constitution and laws. The inspection began after allegations surfaced in May 2023 that children of senior Election Commission officials, including former Secretary-General Park Chan-jin and former Deputy Secretary Song Bong-seop, received preferential treatment in career recruitment.


After conducting its own investigation, the Election Commission referred the related individuals to the police for investigation and stated that it would sincerely cooperate with the National Assembly's state audit and the Anti-Corruption and Civil Rights Commission's investigation. However, it refused the BAI's job inspection. Later, it partially accepted the inspection but shifted its stance, arguing that the scope of the audit needed to be clearly defined, and filed the jurisdictional dispute adjudication in July of the same year.
