As a measure to prevent human rights violations against President Yoon, the Commission expressed the opinion that it is necessary to comply with due process, such as conducting strict evidence investigations equivalent to criminal proceedings during the presidential impeachment trial by the Chief Justice of the Constitutional Court.

It also expressed the opinion that the Seoul Central District Court and the Central Regional Military Court should keep in mind the principle of non-detention trial, a fundamental principle of criminal law, regarding President Yoon and other defendants related to the declaration of martial law.

The Commission emphasized, "We expect the Constitutional Court, courts, and investigative agencies to actively accept the Commission's recommendations and opinions on measures to prevent human rights violations."
