The court upheld the validity of the party member recall vote calling for Heo Eun-ah, the leader of the Reform New Party, to step down.
On the 7th, the Civil Division 51 of the Seoul Southern District Court (Presiding Judge Kim Woo-hyun) dismissed Heo's provisional injunction request seeking to suspend the effect of the party member recall vote against the Reform New Party.
The court ruled that Heo's appointment of Lee Joo-young as the successor to the Policy Committee Chair on the 10th of last month violated the party constitution and was therefore invalid. It explained that there was no separate dismissal of Chair Lee and that the decision did not go through the Supreme Council resolution as required by the party constitution.
The court judged that the Reform New Party Supreme Council's resolution on the 21st of last month to recall Leader Heo met both substantive and procedural requirements.
The court stated, "Considering Heo's violation of the party constitution and the autonomy of the party, the recall resolution is valid. The fact that the Party Affairs Audit Committee was not properly constituted at the time and that no request for implementation was made does not mean the Supreme Council's resolution is illegal."
Earlier, based on the results of the party member recall vote conducted on the 24th and 25th of last month, the Reform New Party decided to remove Heo from the leadership position. Heo filed a provisional injunction to suspend the effect of this decision in objection.
