From around 11:05 PM to 11:34 PM on the day martial law was declared, Kim, who received the instructions sequentially, ordered key officials within the Ministry of National Defense Investigation Headquarters investigation team, including the investigation chief, through the situation room chief of the investigation team, to "immediately issue an emergency assembly order to affiliated investigators, wear black uniforms, prepare military police and investigator patches, and wait in the office," according to the prosecution.

Then, around 11:42 PM, Gu, the head of the Counterintelligence Command Investigation Coordination Division, again requested Kim to ascertain the status of detention cells in the metropolitan area. In response, Kim instructed the planning section chief of the planning department to check and report on the status of detention cells at the Capital Defense Command. Subsequently, around 11:50 PM, Kim received a request from Gu to prepare transfer measures for the detainees and informed the planning section chief of this fact. He also called the commander of the Capital Defense Command Police Unit to request preparation for the transfer of detainees. According to the prosecution's investigation, Kim said, "The three detainees held in the detention cells may need to be transferred to prison," and "If arrests continue one after another, the detention cells at the Capital Defense Command can be used as single-occupancy rooms."
