Request for Detention Review Filed with Seoul Central District Court
Jurisdiction Transfer Petition Submitted for Court Change
More than 20 supporters of President Yoon Seok-yeol, who were arrested for causing violent riots inside and outside the Seoul Western District Court following the president's detention, have filed motions for a detention review and a change of jurisdiction.
According to the legal community on the 30th, they argued that since the Seoul Western District Court is a victim of the recent incident, it is problematic for it to judge the legality of the perpetrators' detention, and thus filed a detention review petition with the Seoul Central District Court.
Additionally, they reportedly submitted a jurisdiction transfer request to the Seoul High Court, asking for the case to be moved from the Western District Court to the Central District Court.
A lawyer representing one of the detained supporters claimed, "Even people who did not enter the court have been detained, and blanket issuance of arrest warrants is taking place."
According to the Criminal Procedure Act, if it is deemed difficult for a trial to proceed fairly, the prosecutor or defendant may request a transfer of jurisdiction to a higher court.
So far, about 20 supporters of President Yoon have applied for detention reviews and jurisdiction transfers. The lawyer explained that additional applications are planned to be submitted by the 31st, after the holiday.
