Yoon: "Riots and Subversion, Prosecutors' Office is Treason"
Yoon Seok-yeol's Legal Team Continues External Public Opinion Campaign
As the High-ranking Officials' Crime Investigation Agency (Gong-su-cheo) and the police enter the final countdown to their second attempt to execute an arrest warrant, President Yoon Seok-yeol's side has claimed that the very attempt by Gong-su-cheo constitutes 'treason.' They emphasized that the illegal warrant was requested by Gong-su-cheo, which lacks investigative authority, and that the court's issuance of the warrant amounted to a 'legislative act,' thereby disrupting the constitutional order. They stated that the act of illegally arresting the president by force is a rebellion excluding state power. The argument is that all elements of treason, including 'purpose' and 'rebellion,' are fulfilled.
They also described the situation as a 'fake treason hysteria show,' despite the fact that martial law is an exercise of presidential authority based on the constitution. The logic is that martial law is a political act and thus not subject to judicial review. With the Constitutional Court's first impeachment hearing approaching and the execution of the arrest warrant becoming imminent, it is interpreted that President Yoon Seok-yeol's side is continuously conducting an external public opinion campaign.
On the 10th, Yoon Gap-geun, the lawyer representing President Yoon, issued a statement titled 'Illegal Attempt to Arrest the Highest Constitutional Institution, the President, Constitutes Treason' to reporters. He mentioned that Gong-su-cheo and the police are preparing to deploy riot police, special forces, and criminal riot police, as well as possibly helicopters and armored vehicles, ahead of the second execution of the arrest warrant. Lawyer Yoon stated, "This is a clear act of treason involving the mobilization of troops and force with the purpose of excluding state power or disrupting the constitutional order."
Lawyer Yoon emphasized, "The act of illegally arresting the sitting president, who is the highest constitutional institution and head of state, by mobilizing large-scale force is a rebellion that excludes state power."
He also reiterated the claim that the president's martial law is not subject to judicial review. Lawyer Yoon cited a passage from the U.S. Supreme Court ruling that the president's authority is 'final and unquestionable, excluding other discussions or procedures.' He said, "(The U.S. Supreme Court) emphasized that the president's exercise of constitutional authority must be granted absolute immunity from criminal prosecution and is not subject to judicial review."
Lawyer Yoon stated, "The president's legal representatives clearly declare that the disloyal anti-state forces participating in such treasonous acts must bear appropriate legal responsibility and be held fully accountable."
Meanwhile, Gong-su-cheo announced on the 7th that "the re-requested arrest warrant for (President Yoon) was issued this afternoon." After the previous warrant expired the day before, they re-applied for the arrest warrant at the Seoul Western District Court and obtained it on the same day. Gong-su-cheo and the police preparing to arrest President Yoon have notified Park Jong-jun, the head of the Presidential Security Service, of a third summons after he failed to comply with two previous summonses, tightening the investigation into the obstruction of special official duties by senior officials of the Presidential Security Service.
