Strong Unconstitutionality Elements in the Double Special Investigation Act

On the 31st, the People Power Party recommended that Choi Sang-mok, Acting Prime Minister and Minister of Economy and Finance, exercise the right to request reconsideration (veto) regarding the Special Investigation Act on Sedition and the Special Investigation Act on Kim Geon-hee.

Kwon Seong-dong, the floor leader of the People Power Party, met with reporters after the party's floor strategy meeting and said, "The double special investigation laws (the Special Investigation Act on Sedition and the Special Investigation Act on Kim Geon-hee) have strong elements of unconstitutionality," adding, "They aim to investigate everything related to the Yoon Seok-yeol administration, making the scope broad and irrational. Our party opposes all special prosecutors recommended by the opposition party," and stated, "We formally request the government to exercise the right to request reconsideration."


Regarding the possibility of compromising within the party by partially amending the special investigation laws, Kwon said, "If the right to request reconsideration is exercised and the bill returns to the National Assembly, the bill vote will take precedence. We plan to first reject it and then discuss the next steps."


He also expressed opposition to the appointment of the three constitutional court justices who were elected by the National Assembly. He said, "Our position remains the same as before," adding, "Indictment and trial should be separated. The acting authority can only maintain the status quo, not make changes, so we maintain our party's position that they should not be appointed."


Meanwhile, regarding the issuance of an arrest warrant related to President Yoon Seok-yeol, Kwon criticized, saying, "The investigative agencies should have exercised caution." He added, "It would have been appropriate to coordinate opinions more and request attendance regarding the sitting president," and said, "I believe the investigative method is inappropriate in attempting to detain a sitting president through the emergency measure of an arrest warrant."
