Supreme Court Division 2 Confirms Lower Court Ruling

Attorney Kang Yong-seok, who was prosecuted for instigating false accusation, has had his suspended prison sentence finalized.
According to the legal community on the 22nd, the Supreme Court's 2nd Division dismissed Kang's appeal on the 6th and upheld the original ruling that sentenced him to six months in prison with a two-year suspension.
Previously, the second trial court pointed out that "despite having a prior record of punishment for similar offenses as a lawyer, Kang instigated false accusations again without any remorse, which reflects a very poor nature of the crime."
Kang was indicted on charges of urging Kim Mina, known as the famous blogger 'Dodommam,' in 2015 to falsely accuse securities firm executive A of rape resulting in injury. In court, Kim testified that Kang instigated the false accusation for the purpose of a settlement payment and that she had never been sexually assaulted or molested by A.
With the suspended prison sentence finalized, under the Attorney-at-Law Act, which disqualifies lawyers during the suspension period plus an additional two years, Kang will be prohibited from practicing law for the next four years.
Kang also had a separate case where he was indicted for raising allegations of collusion between financial companies and politics related to former Jo Guk Innovation Party leader Jo Guk. He received a fine in the second trial, and the Supreme Court dismissed his appeal. On the 20th, the Supreme Court's 3rd Division upheld the original ruling that sentenced Kang to a fine of 5 million won for defamation under the Information and Communications Network Act.
