Constitutional Court: Impeachment Trial Documents Not Yet Delivered to President Yoon

On the 20th, it was confirmed that President Yoon Seok-yeol, against whom an impeachment trial was requested at the Constitutional Court on the 14th, has not yet received the related documents.


Lee Jin, the Constitutional Court spokesperson, stated in a briefing that "the status of document delivery to the president remains undelivered as of yesterday," and added, "the lifetime justices reported the progress of the preparatory procedures for the trial during the justices' conference yesterday, and the full bench shared the situation awareness."

The Constitutional Court, which received the National Assembly's impeachment resolution on the 14th, has attempted various methods such as postal mail, personal delivery, and electronic delivery to send documents including the notice of receipt of the impeachment trial from the 16th, but all attempts have failed.


Documents sent by mail to the official residence were not delivered due to "rejection by the security office," and those sent to the presidential office were undelivered due to "recipient absence." President Yoon is reportedly staying at the Hannam-dong official residence without any special schedule.


Justices Lee Mi-seon and Jeong Hyeong-sik reported this undelivered situation to the full bench composed of six justices the day before, and it is known that there was discussion among the justices regarding this matter.


The spokesperson said, "Details cannot be disclosed due to the confidentiality of the conference."


The Constitutional Court is considering several methods, including delivery upon dispatch, which presumes delivery at the time of mailing; detention or supplementary delivery, which involves leaving documents or handing them to staff; and public notice delivery, which takes effect two weeks after posting on bulletin boards.


The Constitutional Court plans to proceed with the first preparatory hearing for President Yoon's impeachment trial scheduled for the 27th as planned. Since the respondent is not obligated to attend the preparatory hearing, President Yoon is expected not to appear.
