Provision of Guidelines on Invalidation Trials for Infringement Risks and Other Dispute-Related Precautions and Responses

The Korea International Trade Association (KITA) announced on the 22nd that it jointly held a 'Legal Seminar on Responding to Trade Disputes' with the Ministry of Justice at the Trade Tower in Samseong-dong, Gangnam-gu, Seoul. The seminar shared know-how on responding to patent disputes, such as filing invalidation trials for patents at risk of infringement.

KITA explained that the seminar was organized to enhance companies' understanding of trade disputes including trade fraud, international arbitration and litigation, patents, and intellectual property rights, and to provide response guidelines. About 120 officials from export-import companies attended the seminar.


The seminar included presentations on the Ministry of Justice’s legal support system for overseas expansion companies, strategies for preventing and responding to trade fraud, dispute resolution methods such as international arbitration and litigation for overseas expansion companies, and characteristics and response strategies for patent disputes to consider when expanding abroad.


The Ministry of Justice provided detailed guidance on the characteristics of different types of trade fraud, prevention methods, and response measures. It also explained the legal support systems it operates, including online legal consultations, one-on-one legal counseling sessions, and the publication of international legal materials.


Jung Hong-sik, Director of the International Legal Affairs Bureau at the Ministry of Justice, emphasized, "When international legal disputes arise, companies face unfamiliar issues such as dispute procedures in foreign courts and commercial arbitration centers, overseas service of process, and enforcement by foreign courts. It is important to be well-informed about various legal issues in advance and to prevent and prepare for disputes."


Nam Moon-gi, a lawyer at Bae, Kim & Lee LLC, said, "Responding to patent litigation incurs enormous costs. Proactive measures such as patent research and design-around to avoid patent infringement, and filing invalidation trials for patents at risk of infringement are crucial."


Park Sung-hwan, Head of the Trade Promotion Division at KITA, said, "We hope export companies will establish efficient response measures through the seminar. KITA will continue to hold events so that export companies maintain steady interest and preparedness regarding trade disputes."
