A woman’s story has been shared about how she chose to reconcile with her husband due to their child after divorcing by mutual consent because of his infidelity, only to discover that her husband’s mistress had been acting as the legitimate wife.


Recently, JTBC’s ‘Sageon Banjang’ reported the story of a woman in her 40s, Ms. A. Six years ago, Ms. A divorced her husband by mutual consent due to his frequent business trips and overtime work. Custody of their child was granted to the husband. However, three months after the divorce, their ten-year-old son fell seriously ill, and Ms. A decided to reconcile with her husband with the intention of raising their child well together.


One day, Ms. A discovered evidence of her husband’s affair when she found a receipt from a high-end restaurant in his wallet. The day he visited the restaurant was the same day he had told friends he was going fishing. Moreover, the husband’s infidelity had been ongoing even before the divorce.


The husband even disparaged Ms. A to the mistress, showing her photos and calling her “a total ajumma.”


When Ms. A threatened legal action by saying she would file a lawsuit against the mistress, the husband apologized, calling it “a thing of the past.” Concerned about their son’s health, Ms. A reluctantly accepted this.

However, recently Ms. A witnessed her husband walking arm in arm with a woman within the same apartment complex. The husband was still seeing the mistress he had said he would end things with a year ago. The mistress had even moved near the apartment where Ms. A and her husband lived and openly acted as the legitimate wife in the neighborhood.


Ms. A revealed, “When the mistress went to the hair salon or the laundromat, she openly introduced my husband as her own. Even the post office staff addressed the husband’s registered mail to the mistress as ‘samo-nim’ (a respectful term for a married woman). I was too busy taking care of my sick child to notice.”


At her mother-in-law’s 80th birthday party, the mistress wore a hanbok and even took family photos. Ms. A said there was a photo of the mistress hanging in the master bedroom of her in-laws’ house.


One day, Ms. A confronted her husband and the mistress holding hands in the neighborhood, asking, “Aren’t you ashamed in front of our son?” She claims that she was instead assaulted by her husband. Ms. A said, “My son, who was cured after five years of illness, was the first to say, ‘Now that I’m all better, let’s punish that woman,’ which gave me the courage.” She is currently considering legal action.


Attorney Park Ji-hoon, who heard the story, said, “Although the mistress may have been treated like the legitimate wife and it may appear like a de facto marriage, under our law, if there is a legal marriage, a de facto marriage has no meaning.” He added, “The actions of the mistress cannot be legally recognized.” He advised, “Since the infidelity has been repeated continuously, the statute of limitations does not apply. It seems possible to file a damages lawsuit against both the husband and the mistress.”
