A man in his 40s who threw a brick and injured a staff member after being disturbed from a good night's sleep due to a drama filming near his home at midnight was sentenced to imprisonment.
On the 29th, Judge Park So-jeong of the Criminal Division 2 at the Seoul Central District Court sentenced Mr. A, a man in his 40s accused of causing injury by gross negligence, to six months in prison on the 24th, according to News1.
Mr. A is accused of throwing a brick at a drama filming site in Changsin-dong, Jongno-gu, Seoul, at around 3:25 a.m. on April 26 last year, injuring Ms. B, a female staff member in her 20s at the scene. The drama featured actress Park Eun-bin and aired in the second half of last year.
At the time, the drama filming was taking place in an alley near Mr. A’s residence. Annoyed by the noise and lighting from the late-night filming disturbing his sleep, Mr. A went out onto his balcony and looked around. He decided to break the lighting equipment installed by the filming crew on the rooftop of his building and picked up a brick from the balcony to throw at the lighting equipment.
However, the brick missed the lighting and fell straight down below the balcony, hitting the back of the head of Ms. B, a female staff member in her 20s who was at the scene. Ms. B sustained a 4 cm laceration on her head and required hospital treatment. At the time of the incident, there were about 40 people related to the drama filming present, and the brick thrown by Mr. A was reported to be 190 cm wide, 90 cm long, and 55 cm high.
The court pointed out, "There were about 40 drama filming crew members in the alley in front of the defendant’s residence, and the balcony was structured so that people could be seen. Anyone could easily foresee that if a heavy object such as a brick fell in such a situation, it could cause personal injury." The court added, "There was a duty of care to prevent objects from falling and thereby prevent personal injury."
Furthermore, the court explained the sentencing rationale, saying, "The defendant, angered by the noise from the drama filming, threw a brick from his balcony, causing a laceration to the back of the head of the victim who was standing nearby for the filming. Considering the motive and circumstances of the defendant’s crime, the culpability is serious. The defendant committed this crime around April last year and has yet to compensate the victim for the damage."
