A factory manager was caught leaving the scene without taking any action after a longtime colleague clutched his chest and collapsed during an argument, sparking controversy.


On the 26th, News1 reported on the story of Mr. A, a man in his 60s who passed away around August. Mr. A suddenly collapsed and died from a heart attack while arguing with factory manager Mr. B over work-related matters. However, Mr. B saw Mr. A collapse but left the scene without helping, and Mr. A ultimately died.

Mr. A’s son said, "My father lived in the factory dormitory and, even after dinner, if he had nothing else to do, he would operate the machines," adding, "He worked as if running his own business." He also said, "My father and Mr. B were colleagues who had known each other even before I was born," and "They were apart for a while due to family circumstances but reconnected and worked together again starting in 2016."


When Mr. A’s son asked Mr. B about the accident, Mr. B claimed, "I didn’t see him collapse at the time." However, after CCTV footage was released, Mr. B changed his story, saying, "I thought he just tripped over his own feet," according to Mr. A’s son. Mr. A’s son expressed frustration, saying, "As you can see from the video, he definitely did not fall because he tripped over his feet," and added, "The factory owner still hasn’t contacted the bereaved family even once."

Furthermore, Mr. A’s son said, "It’s very upsetting that a longtime colleague collapsed and Mr. B just ignored it and went inside," and added, "I think thousands of times a day about how if at least some action had been taken when he collapsed, my father wouldn’t have left us so tragically." He also said, "When I spoke with the prosecutor yesterday, I was told the investigation was closed as a natural death," and added, "Our family, devastated by losing my father in an instant, has filed a complaint for abandonment and neglect resulting in death."


Meanwhile, abandonment and neglect resulting in death has recently become a hot issue through various cases. This crime is established when a person is placed in a dangerous condition and left unattended, resulting in death. It is a crime applied when a serious outcome of life being taken occurs in addition to abandonment, and is stipulated in Article 271 of the Criminal Act.


Since abandonment and neglect resulting in death is a crime arising from the element of ‘neglect,’ ignoring or passing by a situation indifferently can lead to legal responsibility. Especially, those with legal duties such as parents, guardians, and teachers bear heavier responsibility.


Among these, a recent case caused significant social controversy. An elderly person collapsed on the street, but a passerby who witnessed it did not help and just passed by. The elderly person ultimately died without receiving timely treatment. In this case, the passerby was prosecuted for abandonment and neglect resulting in death, and the court ruled that "although the person in danger was discovered, failure to actively rescue led to death." Another example involved parents leaving their minor child in an inappropriate environment, resulting in the child’s death. In this case, the parents knew of the child’s dangerous situation but neglected them, and as a result, abandonment and neglect resulting in death was established, leading to a heavy sentence.
