HS Hyosung Advanced Materials announced on the 30th that a U.S. court once again dismissed Kolon Industries' patent infringement claims regarding hybrid tire cord (HTC) on the 27th.
Following the Central District Court of California's dismissal of Kolon's first amended complaint in July, the court also dismissed the second amended complaint.
The court explained that Kolon's direct infringement claims were based on the sales activities of tire manufacturers, not HS Hyosung, and that direct infringement claims based on third-party actions could not be recognized.
Additionally, all of Kolon's claims of indirect infringement and willful infringement were also rejected.
HS Hyosung stated, "We welcome the court's decision, which clearly pointed out that Kolon's claims are not based on facts."
