Union official stalked delivery company CEO and spouse... First trial sentenced to prison with probation


A suspended prison sentence was handed down to a union official who persistently harassed a courier company owner and his wife.


On the 30th, Judge Lee Juhwang of the Ulsan District Court Criminal Division 9 announced that he sentenced Mr. A, a man in his 50s who was tried for violating the Stalking Crime Punishment Act, to 1 year and 2 months in prison with a 3-year suspension.


Mr. A, a union official, was indicted on charges of stalking Mr. B, the owner of a courier company in Ulsan, and his wife Ms. C, who was registered as an employee, dozens of times from early May to early July 2022 by watching or following them. Mr. A is accused of following Ms. C as she got into a vehicle, peering inside the window, and approaching her while she was resting to watch her for a while. He also followed Ms. C, who was engaged in courier delivery work, took photos, and wandered in front of her office and home about 20 times.


The court ordered Mr. A to stop stalking and prohibited him from approaching within 100 meters, but he continued stalking by holding picket protests next to Ms. C’s vehicle and taking pictures of her. Additionally, while watching Mr. B and Ms. C unload and sort courier packages on the floor of an apartment parking lot, he filmed them with his phone and shouted that they were illegally leaking customer information. Mr. A, a union official of the Ulsan Courier Union, committed these acts amid conflicts with the courier company over Saturday delivery, same-day delivery, and delivery fees, and after six union members lost their jobs.


The court stated, “Mr. A continuously engaged in stalking acts that caused anxiety or fear to the victims and did not comply with the court’s provisional measures. Considering that the victims likely suffered significant mental distress without compensation, the relatively long stalking period, and the considerable number of incidents, these factors were taken into account.” However, the court explained the sentencing by noting, “Mr. A admitted his wrongdoing and showed remorse, and since he moved to another region, the risk of reoffending against the victims appears low.”
