If Debt Is Not Fulfilled Despite Execution Order Decision
License Suspension, Travel Ban, and Other Sanctions Apply
From now on, if the child support debt exceeds 30 million won or if the payment is not made more than three times despite receiving a compliance order, the individual will be subject to not only public disclosure of their name but also driver's license suspension and travel restrictions. This is due to the simplification of the sanction procedures against parents who intentionally fail to pay child support, and it is expected that the period for taking measures against child support defaulters will be significantly shortened.
On the 10th, the Ministry of Gender Equality and Family announced that the amendment to the Enforcement Decree of the "Act on Securing and Supporting Child Support Payment" containing these details was approved at the Cabinet meeting. Following the enforcement of the "Act on Securing and Supporting Child Support Payment" in March, the enforcement decree was also amended to stipulate the criteria for selecting subjects of sanctions.
With this legal amendment, the previous process of 'compliance order → detention order → sanction' will be changed so that sanctions can be imposed immediately after the compliance order. In the enforcement decree, while previously those who failed to pay child support even after a 'detention order' were subject to sanctions, the target will now include those who fail to pay child support after a 'compliance order'.
Specifically, ▲ if the unpaid child support debt subject to payment under the compliance order is 30 million won or more ▲ or if the obligation is not fulfilled more than three times after receiving the compliance order, the individual will be subject to driver's license suspension requests, travel restrictions, and public disclosure of their name.
The Ministry of Gender Equality and Family expects that the number of sanctions and the duration of sanction periods will increase and shorten respectively due to the amendment of the enforcement decree. Last month, the Ministry deliberated and decided on 139 subjects for sanctions, resulting in a total of 180 sanction decisions.
