A man in his 40s who wielded a weapon after being ignored by his boss at his workplace following his release from prison was sentenced to a heavy prison term again in the appellate court.


On the 3rd, Yonhap News reported, "The Daejeon High Court's 3rd Criminal Division (Chief Judge Kim Byeong-sik) dismissed the appeal filed by Mr. A, in his 40s, in the attempted murder case appellate trial." Mr. A's side claimed that the crime was committed to return to prison and that there was no intent to kill, but the court did not accept this.


The appellate court ruled, "It is reasonable to believe that the defendant recognized or anticipated that his actions could result in the victim's death. He committed the crime to return to prison, and the claim that he was misled during interrogation and gave false statements is hard to believe." It added, "The original trial court judged that even if the murder crime, which is an absolute violation of the value of life, was only attempted, it cannot be tolerated. It also considered that the victim suffered physical and psychological shock and endured long-term pain."


Furthermore, the court explained the reason for dismissing the appeal, saying, "Although 10 million won was deposited as a criminal bond this time, there is no need to change the sentencing conditions determined in the first trial to impose a lighter sentence."


Earlier, Mr. A was accused of attempting to kill his senior colleague Mr. B (36) by wielding a weapon at a company in Yuseong-gu, Daejeon, at 7:42 a.m. on January 31. At the time, he stabbed the victim in the chest with the weapon and tried to attack again, but other employees intervened, resulting in an attempted murder.


It was reported that the day before the crime, Mr. A was upset after being criticized for unfamiliarity with work procedures while working with Mr. B, and he became angry when asked questions about work procedures. Later, when Mr. B ignored him and treated him like an invisible person, Mr. A became enraged and, thinking "I should go back to prison," took a weapon from his home in Jung-gu and committed the crime.


Mr. A served a 1 year and 6 months prison sentence at Daejeon Prison for special injury charges and was released in February last year. The first trial court sentenced him to six years in prison, stating, "The crime was committed solely because the victim was thought to be ignoring him and he wanted to return to prison, which is a very bad crime. Especially, despite having a prior violent crime conviction and serving a prison term, he did not show remorse and committed the crime during the recidivism period, making it difficult to see signs of repentance."
