Submitting Maintenance Plans During Architectural Review and Permitting Process
Yongsan-gu, Seoul (District Mayor Park Hee-young) announced on the 8th that it will be the first autonomous district in Seoul to improve residents' passage services through systematic management of the 'building setback area' starting this month.
The building setback area is private property but is actually adjacent to the road. The district intends to manage this area to resolve inconvenience complaints and enhance passage safety and maintenance efficiency. According to the Building Act, a road refers to a width of 4 meters or more that allows pedestrian and vehicle traffic. If the width is less than 4 meters, the building line is set back 2 meters from the road centerline.
Since the part where buildings can be constructed is excluded from the land area, discrepancies often occur between the land area on the land register and the site area on the building register, causing confusion in complaints. It is difficult to identify whether the setback area is private or public land on-site without a current map.
Even if complaints arise due to road damage or poor maintenance, it is difficult to resolve them because the area is private property and the management responsibility lies with the owner. It is also challenging to enforce regulations or take improvement measures if parked vehicles or stored items obstruct passage.
Accordingly, the district plans to require submission of a maintenance plan for the building setback area during building review and permit issuance for new constructions, making it a condition for building approval. Upon use approval, a maintenance agreement for the building setback area will be recorded in the building register, allowing the district to maintain road repairs and paving for that area after building completion. The agreement will automatically transfer even if ownership changes.
District Mayor Park Hee-young stated, “We will strive to actively manage the building setback area, which was previously a blind spot in management, to ensure residents' safety and convenience through proactive administration.”
