Difference Between Tenants Defrauded in Jeonse and Other Victims Is the Right of First Refusal
The Ministry of Land, Infrastructure and Transport recognized 1,065 tenants as victims of Jeonse fraud over the past month.
The ministry announced on the 20th that it held three plenary meetings of the 'Jeonse Fraud Victim Support Committee' and decided that out of 1,497 tenants, 1,065 were classified as 'Jeonse Fraud Victims' and 'Jeonse Fraud Victims, etc.' These individuals are subject to the 'Special Act on Support for Jeonse Fraud Victims and Housing Stability' (Jeonse Fraud Victim Act), which supports the auction and public sale procedures of tenants affected by Jeonse fraud and ensures housing stability. 'Jeonse Fraud Victims' have the right to exercise a preemptive purchase option on the affected property, but 'Jeonse Fraud Victims, etc.' do not. As a result, tenants classified as 'Jeonse Fraud Victims, etc.' sometimes file objections to be recognized as 'Jeonse Fraud Victims.'
According to the processing results, the committee classified 1,065 individuals as 'Jeonse Fraud Victims' and 'Jeonse Fraud Victims, etc.,' while 202 did not meet the criteria and were not recognized as victims. Additionally, 66 objections were rejected, and 164 were excluded from victim status. The 164 were excluded because they could recover their full deposit through guarantee insurance and priority compensation.
During the review of 1,497 cases, 134 objections were filed, of which 68 were classified as 'Jeonse Fraud Victims' and 'Jeonse Fraud Victims, etc.' Up to the 19th, a total of 1,600 objections had been filed, with 793 applications received. The committee dismissed 725 objections and is currently reviewing 82 applications.
The cumulative number of individuals classified as 'Jeonse Fraud Victims' and 'Jeonse Fraud Victims, etc.' by the Jeonse Fraud Victim Committee is 18,125. There have been 836 approvals for urgent auction and public sale suspension cooperation requests, and a total of 11,752 cases of support have been provided to victims, including housing, financial, and legal procedures.
Tenants who are not recognized as victims of Jeonse fraud and those classified as 'Jeonse Fraud Victims, etc.' may file objections. Even if an objection is dismissed, relief can be sought through reapplication if circumstances change in the future.
A total of 2,401 tenants did not meet the criteria to be classified as 'Jeonse Fraud Victims' or 'Jeonse Fraud Victims, etc.' Among them, 1,307 tenants did not meet the 'intent to withhold deposit return' criterion, and 1,043 tenants did not meet the 'multiple victim occurrence and intent to withhold deposit return' criterion.
Tenants experiencing difficulties due to Jeonse fraud can apply for victim recognition at the municipal or provincial office with jurisdiction over their residence. Once decided as victims through committee resolution, they can receive guidance on support measures through the Housing and Urban Guarantee Corporation (HUG) Jeonse Fraud Support Center (in-person and phone) and its branches (in-person).
