The prosecution requested the same fine of 15 million KRW as the original trial in the retrial on remand for Park Kyung-gwi, Mayor of Asan, on charges of violating the Public Official Election Act.
On the 4th, during the sentencing hearing of the retrial on remand held by the 3rd Criminal Division of the Daejeon High Court (Presiding Judge Kim Byung-sik), the prosecution asked the court to uphold the original ruling that imposed a fine of 15 million KRW on Mayor Park.
If a fine of 1 million KRW or more is confirmed for violating the Public Official Election Act, the election is invalidated.
Mayor Park was prosecuted for spreading false information about Oh Se-hyun, former Mayor of Asan and his opponent in the 8th nationwide simultaneous local elections in 2022, and was sentenced to a fine of 15 million KRW in both the first and second trials.
The Supreme Court overturned the original ruling and sent the case back to the Daejeon High Court, citing procedural issues, stating that the defense attorneys were not notified of the receipt of the litigation records before the judgment.
The court plans to deliver the verdict for Mayor Park's retrial on remand on July 9.
