[Breaking News] Constitutional Court Rules Civil Code Provision Recognizing Inheritance Portion for Deceased's Siblings Unconstitutional

On the 25th, the Constitutional Court ruled the provision in Article 1112, Clause 4 of the Civil Act, which grants one-third of the statutory inheritance share as a reserved portion to the deceased's siblings, as unconstitutional in a constitutional review case concerning the reserved portion provisions under the Civil Act. The court stated that it "exceeds the legislative limits of restricting fundamental rights under Article 37, Paragraph 2 of the Constitution and infringes on property rights," and made a simple unconstitutional decision.


The Constitutional Court explained, "It is difficult to find a reasonable basis for granting reserved portion rights to the deceased's siblings, despite the fact that their contribution to the formation of the inheritance property or their expectation of inheritance property is hardly recognized."
