Court Calls Crime Serious, Rejects Appeal... 2 Years 6 Months Sentence
A man in his 30s who attempted to kill a woman in her 20s with a blunt weapon, suspecting an affair with his wife, was sentenced to 2 years and 6 months in prison in the appellate court as well.
The Criminal Division 1 of the Daejeon High Court (Chief Judge Park Jin-hwan) announced on the 22nd that it dismissed the appeal of A (33), who was sentenced to 2 years and 6 months in prison in the first trial on charges of attempted murder, and upheld the original sentence.
A suspected his wife (32) was having an affair after seeing her frequently contacting and visiting B (29), an unmarried female office worker she met through a women's soccer club. Later, after stealing his wife's cellphone, A became convinced that B was in a lesbian relationship with his wife.
On April 7 last year, around 2:20 a.m., A went to an apartment in Taean-eup, Taean-gun, Chungnam, where B lived, called her outside, and demanded, "Stop meeting my wife and do not contact her anymore." During the confrontation, a quarrel broke out, and A assaulted B with a blunt weapon.
When B collapsed bleeding, A told his wife, who arrived at the scene, "I will kill myself too," and fled in his car. The attacked B was taken to the hospital for treatment.
Afterward, the police, upon receiving a report from A’s wife, tracked the car’s route and cellphone location, and caught A’s vehicle on a road in Palbong-myeon, Seosan-si, 13 km from the scene, one hour after the crime. At the time, A was intoxicated with a blood alcohol concentration of 0.036%.
In the police investigation, A stated, "I thought B was having an affair with my wife, and during the quarrel, I lost my temper and hit B. When I saw a lot of blood, I got scared and fled intending to commit suicide."
The first trial court said, "The crime was planned in advance, including preparing a blunt weapon, and the offender committed drunk driving while fleeing, showing a bad nature of the crime." However, considering that A had no prior criminal record and that B did not want punishment, the court sentenced him to 2 years and 6 months in prison.
