"Black Box Clearly Shows, Yet Accused of Causing Accident and Insurance Fraud"… McLaren Owner's Complaint

Rental Car K5 Owner Admits 100% Fault Late
Insurance Company States "Cannot Provide Compensation," Causing Frustration

The owner of a luxury sports car collided with a vehicle that tried to overtake him by driving against the traffic on the center line, but he is now claiming innocence amid suspicions of insurance fraud. On the 11th, a black box video of the accident involving McLaren owner Mr. A was posted on BobaeDream’s Instagram. The accident occurred at 2 p.m. on the 3rd.

Mr. A explained, "The lane I was entering is very narrow, so after one car passes, vehicles must proceed one by one or drive slowly while yielding to each other." He added, "I slowed down and stopped after seeing a parked car ahead, then let a motorcycle going the wrong way pass before entering." He continued, "Because there were many parked cars on both sides and cars suddenly pulling out, I checked that the front view was clear and pressed the accelerator somewhat quickly. It wasn’t full throttle. The accident happened in less than a second of pressing the accelerator."

Watching the black box footage, Mr. A indeed waited for the parked car, let one motorcycle pass, and then started driving. At the same time, a K5 sedan behind Mr. A’s car suddenly crossed the center line to attempt overtaking, resulting in a collision between the two vehicles. Mr. A said, "The K5 rental car was driving against traffic and collided with my car, but the K5 driver claims that I deliberately refused to yield and caused the accident on purpose." He expressed disbelief, saying, "They claim I caused the accident even though I clearly saw the K5 overtaking."

He added, "If you look at the rear black box, the K5 vehicle did not maintain a safe distance and came within less than 1 meter before attempting to overtake." He explained, "Even if I had to brake suddenly because a car suddenly pulled out in front of me, the accident would have happened anyway. If I had known the K5 was following and intended to cause an accident, I would have slammed the brakes during the entry process."

He continued, "Since I drive a high-end car carefully to avoid even scratches, the claim that I caused an intentional accident is absolutely ridiculous." He expressed anger, saying, "They say I caused the accident on purpose, which makes me angry and resentful." He emphasized, "I didn’t realize the K5 was behind me from the sound of the exhaust or music. It was just a coincidence that I moved forward at the same time the K5 was overtaking; I didn’t know."

Eventually, the K5 rental car driver admitted 100% fault belatedly, but the rental car insurance company reportedly maintains the position that "Mr. A, the McLaren owner, drove recklessly and attempted insurance fraud," refusing to provide compensation. Mr. A’s McLaren is known to be worth about 330 million KRW as a new car.

The black box video was shared across various online communities, sparking public outrage. Netizens reacted with comments such as, "Who thinks of overtaking by crossing the center line on such a complicated road?", "People don’t even go near such luxury cars, but to attempt overtaking by crossing the center line is outrageous," "Even if I were the McLaren owner, I wouldn’t commit insurance fraud like this," and "Why is the insurance company protecting the car that overtook by crossing the center line?"

Meanwhile, crossing the center line is excluded from the 12 major traffic violations under the Special Act on Traffic Accident Punishment, so criminal charges are possible. Violators face a fine of 90,000 KRW or a penalty of 60,000 KRW and 30 demerit points. Accumulating 40 or more points results in license suspension. Additionally, offenders may face imprisonment of up to 5 years or a fine of up to 20 million KRW. The 12 major violations include ▲running a red light ▲crossing the center line ▲speeding over 20 km/h above the limit ▲violating overtaking methods, prohibited times, or places, or illegal lane cutting ▲violating railroad crossing rules ▲failing to protect pedestrians at crosswalks ▲driving without a license ▲drunk driving ▲driving on sidewalks ▲failing to prevent passenger falls ▲violating safe driving obligations in school zones ▲and driving without securing cargo properly.
