Considering victim's agreement, sentenced to 2 years probation
A doctor in his 60s was sentenced to a suspended prison term for illegally filming nursing assistants changing clothes by installing a camera in a microwave oven placed in a hospital changing room.
On the 17th, the Cheonan Branch of Daejeon District Court, Criminal Division 1 (Presiding Judge Kim Jang-gu) sentenced Mr. A to one year in prison with a two-year suspension for violating the Act on Special Cases Concerning the Punishment of Sexual Crimes (filming and distribution using a camera, etc.). Additionally, he was ordered to attend 80 hours of sexual violence treatment lectures.
Mr. A is a specialist running a pediatric and adolescent clinic in Cheonan, Chungnam. He is accused of placing his mobile phone on the microwave oven in the clinic’s changing room before employees arrived at work between April and May, filming nursing assistants changing clothes. There are two victims in total.
The court stated, "Considering that the victims reached an agreement and do not wish to press charges, and that Mr. A admitted his wrongdoing and is remorseful, the sentence was determined accordingly."
On this day, the court did not accept the prosecution’s request for disclosure and notification of personal information and employment restriction orders. The court explained, "Considering the degree of disadvantage the defendant would suffer and the effects on preventing sexual crimes and protecting victims, there are special circumstances not to impose such restrictions."
Meanwhile, under current law, using a camera or similar device to film a person's body in a way that may cause sexual desire or shame against the subject’s will can result in imprisonment for up to seven years or a fine of up to 50 million won.
