43 Calls and Texts of Stalking During Trial
A man in his 20s who assaulted his teenage girlfriend and sent dozens of text messages containing abusive language even while undergoing trial after their breakup was sentenced to prison.
On the 2nd, Judge Jeong Ji-won of the Chuncheon District Court Wonju Branch Criminal Division 3 sentenced A (26), who was detained and prosecuted on charges including injury, special intimidation, violation of the Act on the Punishment of Stalking Crimes, and trespassing, to 10 months in prison. A was also ordered to complete a 40-hour stalking treatment program.
A man in his 20s who sent abusive text messages even during the trial after assaulting his teenage partner and breaking up was sentenced to 10 months in prison.
Earlier, A was indicted for grabbing and shaking the hair of B (16), his girlfriend, hitting her face with his fist, and threatening and intimidating her with a weapon during an argument at a pension in Hoengseong-gun, Gangwon Province, around 2 a.m. on November 13 last year, after he became angry because B slapped him.
After breaking up with B due to this incident and while undergoing trial, A was additionally charged with stalking for making 43 phone calls or sending text messages from 10:52 p.m. on February 27 for about a month, and waiting for B.
A reportedly threatened B via phone calls or text messages, saying, "If you don't call by 1 o'clock, be prepared for all videos and recordings to be posted," and used severe abusive language.
Despite a provisional court order prohibiting A from approaching B or her residence within 100 meters, he did not comply. On February 28, he trespassed into B’s home, entering as she opened the front door to give a final gift, even going as far as the shoe rack inside.
The court stated, "This is a case where the defendant assaulted and injured a minor with whom he was in a romantic relationship and threatened her with a dangerous object, and then stalked the victim during the trial." It added, "Considering the circumstances and the gravity of the crime, the sentence was determined due to the serious nature and high blameworthiness of the offense."
Both A and the prosecution have appealed the first trial verdict.
