Establishing legal grounds for early childhood life guidance
The Ministry of Education will distribute explanatory guides for the 'Notice on Teachers' Student Life Guidance' and the 'Notice for the Protection of Educational Activities of Kindergarten Teachers' to educational sites.
On the 27th, the Ministry of Education announced that it will provide these explanatory guides to educational sites. Earlier, on the 1st, the Ministry promulgated and enforced the Notice on Teachers' Student Life Guidance and began preparing explanatory guides detailing the specifics of the notice.
Going forward, student life guidance by teachers based on the notice authorized by law and the explanatory guides will not be subject to punishment as a "lawful act under the law" (Criminal Act Article 20).
The Ministry explained, "The explanatory guides being distributed this time were co-authored by on-site teachers, including those affiliated with teacher organizations, and education experts. They were finalized after review meetings with on-site teachers and metropolitan and provincial offices of education, circulation and opinion inquiries with related ministries, and meetings with teacher organization representatives."

The explanatory guide for the Notice on Teachers' Student Life Guidance contains detailed content specifying general standards necessary for student life guidance by elementary and secondary school teachers. It also includes the legal framework and usage precautions, support for life guidance, specific situations requiring guidance and guidance methods, Q&A, and necessary forms. The Ministry of Education, metropolitan and provincial offices of education, and school principals provide examples of support needed for teachers' student life guidance.
The explanatory guide for the Notice for the Protection of Educational Activities of Kindergarten Teachers includes examples considering the developmental stages of young children, the scope and methods of life guidance, related laws, Q&A, and precedents. Additionally, following the revision of the Early Childhood Education Act, which established a legal basis for teachers' guidance of young children's lives, the Ministry plans to promptly revise subordinate laws such as the Enforcement Decree and notices of the Early Childhood Education Act.
After distributing the explanatory guides, the Ministry of Education will continue to supplement them by reflecting various opinions from the field in collaboration with the 'Ewha Womans University School Violence Prevention Research Institute.'
