A man in his 50s who sexually assaulted a woman who kindly offered him an umbrella on a rainy day was sentenced to a suspended prison term.


According to the legal community on the 30th, the Gwangju District Court Criminal Division 4 sentenced Mr. A (55), who was indicted on charges of forcible molestation, to six months in prison with a two-year suspension. He was also ordered to attend 80 hours of sexual violence treatment lectures.

Mr. A was brought to trial for allegedly touching the victim's waist and other parts of her body multiple times on a road in front of an apartment in Buk-gu, Gwangju, around 10:30 p.m. on June 23 last year.


At the time, Ms. B, who was carrying an umbrella, offered it to Mr. A, who was walking in the rain, to help him, but Mr. A committed this crime against Ms. B. It was reported that the two were strangers to each other.


Mr. A denied the charges during the trial, but the recorded phone conversation held by the victim served as evidence. At the time, the victim was on a call with her boyfriend with the recording function turned on.


The recording captured Ms. B’s voice refusing Mr. A’s physical contact, saying things like "Please take your hand down," "Wait a moment. Your hand, please," and "Stop it." Despite Ms. B’s clear refusal, Mr. A continued the assault, saying, "It’s okay. I’m a father too."


The court stated, "The victim has consistently testified to the facts of the damage from the investigation agency to the courtroom," and "There is no motive or reason to believe the victim gave false testimony unfavorable to the defendant."


It added, "The use of physical force and the degree of molestation by the defendant at the time of the crime cannot be considered minor," but also explained the sentencing by considering "the defendant has no prior convictions for similar offenses or suspended prison sentences of imprisonment or higher."
