According to the legal community on the 17th, the Seoul Western District Prosecutors' Office submitted an appeal to Judge Kim Yu-mi of the Criminal Division 6 of the Seoul Western District Court on the same day. Kim's side also filed an appeal with Judge Kim on the 13th.
A prosecution official said, "We appealed after carefully considering the malicious nature of the crime and the victim's petition for severe punishment."
In the previous sentencing hearing, the prosecution requested a prison sentence of one year and six months for Kim, who was charged with violating the Special Act on the Punishment of Sexual Crimes (filming using a camera, etc.).
On the 12th, the court sentenced Kim to one year in prison, stating, "The defendant filmed the victim while she was sleeping and posted it in a KakaoTalk group chat room with 10 men. Considering the circumstances, the method of the crime, the content and exposure level of the photos taken, the nature of the crime is bad." The court added, "Although the defendant confessed to all the crimes and showed remorse, and has no prior criminal record except for two instances of drunk driving, considering the seriousness of this case and the irreparable pain of the victim, a corresponding prison sentence is inevitable."
Kim is accused of filming the body parts of the victim A, who was his lover, in Yangyang, Gangwon Province, in July 2018, and sharing the photos in a group chat room with dozens of acquaintances. It is known that Kim deposited 20 million won as compensation and submitted more than 100 letters of apology and petitions to the court. Although he pleaded financial hardship during the sentencing hearing, he was ultimately sentenced to prison and taken into custody in court.
