The Seoul Central District Court Criminal Division 34 (Presiding Judge Kang Gyu-tae) held the second trial for Lee's violation of the Public Official Election Act at 10:30 a.m. that day.

During the trial, the prosecution examined documentary evidence submitted to prove Lee's charges. Lee also appeared in court that morning. He did not respond to questions from reporters as he entered the courthouse.

Lee is accused of publicly making false statements during a broadcast interview on December 22, 2021, when he was the Democratic Party's presidential candidate, regarding the late Kim Moon-gi, head of Development Division 1 at Seongnam Urban Development Corporation, saying, "I did not know him while I was mayor."

He is also charged with publicly making false statements related to allegations of preferential treatment in changing the land use of the Baekhyeon-dong site of the Korea Food Research Institute during the National Assembly Land, Infrastructure and Transport Committee's Gyeonggi Province audit on October 20 of the same year. At that time, Lee claimed, "The Ministry of Land, Infrastructure and Transport requested the land use change, and we had no choice but to comply under the Special Act on the Relocation of Public Institutions."

However, the prosecution believes that the Ministry of Land, Infrastructure and Transport neither requested nor pressured the land use change for the Baekhyeon-dong site.
