[Asia Economy Reporter Heo Kyung-jun] Since the COVID-19 pandemic, the ‘digital health’ sector?which integrates healthcare and information and communication technology (ICT), including pharmaceuticals, medical devices, and medical services?has emerged globally as a promising new industry. Although digital health is rapidly rising as a new industry, the application of regulations related to healthcare and personal data protection is inevitable, making meticulous legal review essential during product development and commercialization processes.


In response to the paradigm shift in medical services, Law Firm Kwangjang has formed a ‘Digital Health Team’ composed of 20 experts in ICT, personal data protection, healthcare, pharmaceuticals, and medical devices.


The key members of the Digital Health Team are all professionals with over 10 years of experience in their respective fields. Their goal is not merely to provide simple legal advisory services in the digital health sector, where healthcare and ICT converge, but to offer in-depth total services that also consider government policies and industry trends.


The digital health sector is considered one of the fastest-changing fields. Digital health, which provides diagnosis, treatment, prevention, and monitoring without spatial or temporal constraints, has already become part of everyday life. New types of medical devices that did not exist before, such as digital therapeutic devices (DTX), health diagnosis and screening applications, and wearable devices, have emerged. The legal advisory demand in the digital health sector is explosively increasing and diversifying with content different from before, according to consensus in the legal community.


Kwangjang’s IT & Personal Data Group and Healthcare Group have been providing legal services in the digital health sector for several years. The newly formed Digital Health Team is led by Attorney Park Kwang-bae (Judicial Research and Training Institute Class 17), head of the IT & Personal Data Group, with co-team leaders Attorney Yoon Jong-su (Class 22) of the IT & Personal Data Group and Attorney Jung Jin-hwan (Class 29), head of the Healthcare Group.


Experts in ICT and personal data protection such as Attorney Go Hwan-gyeong (Class 31), Attorney Chae Seong-hee (Class 35), Attorney Son Kyung-min (Class 37), and experts in healthcare, pharmaceuticals, and medical devices including Attorney Oh Soo-yeon (Class 29), Attorney Kim Min-su (Class 43), and Attorney Bang Seung-il (Bar Exam Class 2) are among the key members participating.


Additionally, the Digital Health Team consists of advisors and professional committee members from the Ministry of Health and Welfare, the Ministry of Food and Drug Safety, the Health Insurance Review & Assessment Service, multinational pharmaceutical companies, and the Korea Information Society Development Institute, as well as those with extensive know-how and unique expertise accumulated through numerous consultations with domestic and international clients.


Attorney Jung Jin-hwan stated, "The digital healthcare industry is growing at a very rapid pace worldwide due to technological advancements," adding, "Recently, tech companies have selected the digital healthcare sector as a new growth engine and are competing to secure market dominance."


He continued, "Until now, the domestic digital healthcare industry faced many difficulties in pursuing new businesses due to regulations, but recently, with the introduction of the Act on the Promotion of Digital Healthcare and the Utilization of Healthcare Data in the National Assembly, the possibility of ecosystem revitalization through regulatory relaxation is higher than ever," emphasizing, "The Digital Health Team plans to leverage its unparalleled expertise and teamwork to provide prompt, efficient, and optimal legal services tailored to the rapidly changing digital healthcare industry environment."
