120 Million Won Fine for Trespassing and Property Damage
Suspended Sentence for Woman in Her 50s Who Hid Ex-Boyfriend's Delivery Box
[Asia Economy Reporter Kim Hyun-jung] A woman in her 60s who broke the glass window of her ex-boyfriend's house, with whom she had lived together, and trespassed without permission was sentenced to a fine.
According to the Daegu District Court on the 8th, Chief Judge Lee Young-sook of Criminal Division 8 sentenced A (62, female), who was indicted on charges of trespassing and property damage, to a fine of 1.2 million won. A is accused of throwing five flowerpots from the rooftop of B's house, a man she once lived with, onto the ground at around 6:40 p.m. on June 30 last year, breaking a glass window in the bathroom by throwing one flowerpot at it, and then entering the house.
A claimed that since she had lived with B, entering B's house did not constitute trespassing, and that five of the six flowerpots were hers, so they were not someone else's property. However, the court did not accept this argument.
Chief Judge Lee stated, "The victim had requested the defendant to discard the key to his house that he had previously given her and had locked the front door, yet the defendant still broke into the house. It is also recognized that all the damaged flowerpots belong to B."
Meanwhile, in Chuncheon, a woman in her 50s who ignored a court order not to contact or approach her ex-boyfriend's house, rang the doorbell, and hid a delivery box was sentenced to a suspended prison term.
On the 7th, Chief Judge Park Jin-young of Criminal Division 2 at Chuncheon District Court sentenced C (56, female), who was indicted on charges of violating the Stalking Punishment Act and concealing property, to eight months in prison with a two-year suspension and ordered her to attend 40 hours of stalking crime recidivism prevention lectures.
C was brought to trial on charges of approaching within 100 meters of her ex-boyfriend D (52) or contacting him despite a court order prohibiting such contact and approach. From the end of April last year for about fifteen days, she went to D's house, rang the doorbell, and attempted contact 14 times via online messengers and other means.
Additionally, C was accused of secretly taking a delivery box containing a mobile phone placed in front of D's apartment entrance and hiding it next to a tree on the first floor of the apartment building after becoming angry that D did not meet her.
Judge Park pointed out, "The defendant did not comply with the court's provisional measures and continued stalking, causing the victim considerable anxiety and fear. She also concealed the victim's property, which worsens the nature of the crime." Regarding the sentencing, he added, "The sentence was determined considering the defendant's remorse and the victim's expressed wish not to pursue punishment."
