30s Threatening Minors with a Weapon over Noise Between Floors Receive Reduced Sentence in Appeal Trial

[Asia Economy (Daejeon) Reporter Jeong Il-woong] A man in his 30s who threatened a minor with a weapon over complaints about noise between floors received a reduced sentence in the appellate court.


According to the local legal community on the 1st, the Daejeon District Court Criminal Appeals Division 2 (Chief Judge Choi Hyung-cheol) recently overturned the original sentence of 1 year and 6 months imprisonment for A (36) and sentenced him to 1 year and 6 months imprisonment with a 3-year probation.


A is accused of threatening B (15), a minor, and others with a weapon on May 22 at midnight in an apartment located in Gongju-si, Chungnam, due to noise complaints from the upper floor.


At the time, A took a weapon from his home and went upstairs. When B opened the door, A squeezed through the door gap and entered the living room, according to the investigation.


During this process, A threatened C, a friend of the same age who was with B at the house, by pretending to stab him with the weapon, and struck D, who was sitting in the living room, on the head with the weapon, causing injuries requiring three weeks of medical treatment.


The first trial court stated, "Considering that the victim is a minor only 15 years old, that the defendant threatened the victim causing extreme fear, and struck the victim’s head with a weapon causing injury, a prison sentence is unavoidable."


However, the appellate court accepted A’s claim of excessive sentencing and reduced the sentence. The court stated, "Considering that the defendant admitted to the crime and is deeply remorseful, and that he has no prior criminal record except for minor fines, we sentence him to imprisonment with probation."
