Studio Santa Claus Wins Lawsuit for 5.3 Billion KRW in Unjust Enrichment Refund

[Asia Economy Reporter Jang Hyowon] Studio Santa Claus announced on the 4th that it has been confirmed to receive a total of 5.3 billion KRW in compensation through the Supreme Court's decision to dismiss the appeal without review in the unjust enrichment refund lawsuit filed against actor Kang Ji-hwan and Jellyfish Entertainment.


The case concerns a lawsuit demanding payment of the appearance fee, penalty, and damages already paid due to actor Kang Ji-hwan's withdrawal from the drama Joseon Survival, produced by the company, following allegations of sexual assault. The Seoul High Court had ruled partially in favor of the plaintiff in May.


In response, Kang Ji-hwan and Jellyfish Entertainment submitted a statement of reasons for appeal, but on the 29th, the Supreme Court ruled that the appeal did not include any of the reasons specified in Article 4, Paragraph 1 of the Act on Special Cases Concerning the Appeal Procedure, or was deemed groundless, and therefore decided to dismiss all appeals pursuant to Article 5 of the same law.


A representative of Studio Santa Claus said, “With the Supreme Court's ruling on the appeal in this case, we will finally be able to receive approximately 5.3 billion KRW in damages and penalties for the losses incurred.”
