Intellectual Data: "Korean Companies Face Most Patent Lawsuits... Difficulties in Early Response"

Competition over intellectual property rights (IP) among companies is intensifying as they vie for dominance in future industries. The 'Patent War 2022' conference held on the 16th at COEX in Samseong-dong, Seoul, was organized to share know-how on how our companies should respond in the silent war surrounding intellectual property rights.


Seo Sang-wook, team leader of Intellectual Data (pictured), who was a speaker, said, "The company that has faced the most patent lawsuits in the past three years is a Korean company," adding, "Many companies struggle with initial responses because they are not familiar with the e-Discovery system, an essential procedure in overseas lawsuits."


e-Discovery, also known as electronic evidence disclosure, is a system where parties in a lawsuit provide each other with information, including electronic documents such as emails and social media. In Anglo-American jurisdictions, if it is judged that relevant evidence has been intentionally destroyed, deleted, or altered during litigation or disputes, the court considers this an act of obstruction of justice and imposes sanctions, and in the worst cases, may declare a ruling against the offending party.


Seo, team leader at legal tech company Intellectual Data, has been responsible for the practical work and management of well-known large-scale projects in Korea. On this day, he introduced the e-Discovery procedure and shared his experiences regarding points that Korean companies should be cautious about in international litigation.


In addition, speakers included Professor Ko Young-hee from Seoul School of Integrated Sciences and Technologies, Team Leader Yoon Seung-hyun from Hyundai Motor Company, Partner Patent Attorney Ryu Min-oh from the patent law firm Seum, and Professor Kim Jin-woo from KAIST Innovation Strategy Policy Institute, who presented on intellectual property rights and patent strategies.
