[Correction and Rebuttal Report] Regarding the Constitutional Court Decision on the Korean Bar Association's 'Attorney Advertising Regulations' Coverage

In the article titled <[Choi Seok-jin's Legal Story] The 7-Year War Between ‘Lotok’ vs ‘Byeonhyeop’ That Did Not End Despite the Constitutional Court's Decision> published on May 29, 2022, this newspaper reported that the Korean Bar Association created the as a last resort following the Ministry of Justice's statement that ‘Lotok is legal,’ and despite the Constitutional Court ruling some key provisions related to Lotok as unconstitutional, the association has not relented in its claim that “Lotok's business method violates the Attorney-at-Law Act.”


However, upon fact-checking, it has been confirmed that the Korean Bar Association created the on May 3, 2021, and the Ministry of Justice officially announced its position on online legal platforms such as Lotok on August 24, 2021; this is hereby corrected.


Meanwhile, the Korean Bar Association has stated, “Since the Constitutional Court has not explicitly ruled that Lotok's business method is permitted, the association plans to continue disciplining lawyers registered with Lotok, and the Constitutional Court has upheld the constitutionality of some provisions for which the Ministry of Justice had expressed unconstitutionality.”
