Violation of Court Restraining Order
Court: "Repeated Offenses, Very Serious Nature"
[Asia Economy Reporter Jang Sehee] A man in his 30s who stalked and threatened his ex-lover by sending over 100 phone calls and KakaoTalk messages has been sentenced to prison.
According to the legal community on the 11th, Judge Min Seongcheol of the Criminal Division 3 at the Seoul Eastern District Court recently sentenced Mr. A, a man in his 30s, to six months in prison on charges of violating the Stalking Punishment Act and intimidation.
Earlier this year, Mr. A went to the store of his former partner, Mr. B, and threatened him. He was prosecuted for sending 148 phone calls and 190 KakaoTalk messages to Mr. B the following day.
Although the court had previously issued a restraining order prohibiting Mr. A from approaching within 100 meters of Mr. B’s residence and from contacting him via telecommunications, the stalking continued. When he visited the store, he also used abusive language.
Moreover, it was revealed that during this period, Mr. A was already being prosecuted and undergoing trial for a separate charge of threatening Mr. B at the end of last year.
The court stated the reason for the prison sentence, saying, "The defendant committed additional harm to the same victim during the ongoing trial for special intimidation and other charges, violated the provisional restraining orders, and the repeated nature of the offenses shows a very poor criminal attitude."
Meanwhile, in the first trial for the March intimidation case this year, Mr. A was sentenced to six months in prison with a two-year probation.
