According to the legal community on the 24th, the Gwangju District Court Criminal Division 3 (Presiding Judge Kim Tae-ho) overturned the original sentence of 10 months imprisonment with a 2-year suspension in the appeal trial of Mr. A, who was charged with involuntary manslaughter due to negligence at work, and sentenced him to 6 months imprisonment.
The fine of 10 million won against Construction Company B, which was charged with violating the Industrial Safety and Health Act, was maintained.
Mr. A was prosecuted for causing a death by failing to implement necessary measures to prevent industrial accidents, such as protective measures and installation of fall protection nets at the construction site.
Mr. A appealed, claiming the first trial sentence was too heavy, but the appeal was rejected.
The court explained, "The degree of violation of the duty of care at work by failing to implement necessary measures to prevent industrial accidents is not light," and "As a result, an irreversible serious outcome of the victim's death occurred."
Furthermore, the court stated the sentencing reasons, saying, "Until this appeal, no agreement was reached with the bereaved family, and the family is pleading for severe punishment," and "Various conditions such as circumstances after the crime and health status were comprehensively considered."
