[Asia Economy Reporter Kim Daehyun] A man in his 20s who was prosecuted for parking without permission for one hour in the parking lot of a piloti-structured villa was sentenced to a fine in the first trial.
According to the legal community on the 22nd, Judge Shim Hyun-geun of the Seoul Central District Court Criminal Division 11 recently sentenced A (29, male), who was indicted for trespassing on a building, to a fine of 500,000 won.
Earlier, A was prosecuted for parking his car on the first-floor parking lot of a piloti-structured villa in Seocho-gu, Seoul, on August 20 last year at 1:14 p.m., taking advantage of the absence of manager B and residents.
The villa where A parked had a structure without a separate parking barrier. Although A received a text message from B asking him to move the car, he did not respond for about an hour, and later, both parties were investigated to have had a dispute over the parking issue.
In court, A and his lawyer denied the charges, stating that "he only parked briefly and had no intent to trespass on the building."
However, the first trial found him guilty. Judge Shim stated, "The first-floor piloti space where the defendant parked is provided for the use of those who utilize the building due to its form and structure," and "It appears objectively clear that it is a space where outsiders should not enter recklessly."
He added, "Considering that the defendant parked for about an hour and received text messages from B requesting the vehicle to be moved but did not respond due to personal reasons, it seems that the defendant had at least indirect intent to trespass on the building."
A appealed against this ruling.
