Court: "There is an obligation to look around and avoid colliding with others"
[Asia Economy Reporter Heo Midam] A woman in her 30s who accidentally poked a passerby's eye while unconsciously pointing at a restaurant was sentenced to a fine.
On the 10th, the Cheongju District Court Criminal Division 5 announced that it sentenced Ms. A (38, female), who was indicted without detention on charges of negligent injury, to a fine of 300,000 won.
Ms. A is accused of poking the right eye of Ms. B (29, female), who was passing in front of her, with her finger and causing injury on a street in Seomun-dong, Sangdang-gu, Cheongju-si, Chungbuk, at 11:43 a.m. on March 23 last year.
At the time, Ms. A was pointing at a store across the street while visiting a pizza place with her daughter, and in the process, poked Ms. B's eye with her finger. As a result of the accident, Ms. B suffered corneal abrasions requiring about a week of treatment.
Ms. A claimed that she did not know anyone would pass by when she pointed at the pizza place with her finger, and that Ms. B's eye injury was minor enough to heal naturally.
In response, the court pointed out, "There were quite a few pedestrians passing by at the location at the time," and "She had a duty of care to look around carefully to avoid hitting other people or objects."
The court added, "It can be acknowledged that the victim felt discomfort after the accident and received a medical certificate diagnosing a 3mm corneal abrasion," and explained the sentencing reason by saying, "The eye, one of the most important organs in daily life, was injured, and the victim has not forgiven the defendant, among other factors."
