[Asia Economy Intern Reporter Kim Nayeon] The driver of a passenger car that collided with a motorcycle carrying two high school students expressed feelings of injustice.
Recently, a video titled "A motorcycle carrying two high school students crashed into me directly" was posted on the YouTube channel 'Han Moon-cheol TV,' stating, "It seems like an accident that no one could have avoided, but I am truly very upset and seeking advice."
The released black box footage shows a vehicle slowly driving on a road and a motorcycle coming from the opposite direction colliding.
The vehicle driver and informant, Mr. A, explained, "Since it was my usual commute to work, I was aware that it was a school zone and entered the side road at a low speed. I also noticed the motorcycle coming from the opposite side and was driving slowly enough to stop immediately if I pressed the brake." He added, "The motorcycle sped down the middle of the road at a tremendous speed, and the accident happened as it was."
He continued, "Because the motorcycle riders were third-year high school students, they did not have license plates and were essentially uninsured."
According to Mr. A, the road where the accident occurred was wide enough for about two vans to pass side by side. He mentioned that the accident happened in a split second, so he could not honk the horn separately.
He lamented, "It seems like an accident that no one could have avoided, so do I have to bear all the responsibility?" and asked, "If I am found at fault, I want to know exactly which part I am at fault for," seeking advice from a lawyer.
A lawyer advised, "If no agreement is reached with the motorcycle driver, the driver will be punished, and the passenger will have to reach a criminal settlement." He added, "If an agreement is made, there will be no punishment. Although the motorcycle was more at fault, whether it is 100% fault depends on the judge's decision."
He further explained, "If you meet a judge who thinks you should have honked the horn just in case, Mr. A could be found 10-20% at fault. However, it is unrealistic for the driver to be at fault in such cases. The motorcycle is 100% at fault."
